Please note that this Privacy Statement will be updated regularly to reflect any changes in the way we handle your personal data or any changes in applicable laws. The following statement applies to Arkphire Ireland Limited trading as Presidio and all entities within the Arkphire Group. For clarity, the company will be referred to as Presidio going forward in this statement.
We understand that your privacy is important to you and that you care about how your personal data is used. We respect and value the privacy of everyone who interacts with us and will only collect/use personal data in ways that are described here, and in a way that is consistent with our obligations and your rights under the General Data Protection Regulation (EU Regulation 2016/679) (the “GDPR”)

In this Notice, the following terms have the following meanings:
- “Personal Data” means any and all data that relates to an identifiable person who can be directly or indirectly identified from that data. In this case, it means personal data that you give to Presidio via our website (Site). This definition shall, where applicable, incorporate the definitions provided in the Data Protection Acts 1988, 2003 and 2018 and the EU Regulation 2016/679 – the General Data Protection Regulation (“GDPR”).

This Privacy Statement applies to data we collect, use, and otherwise process about you in connection with your use of our website and your interactions with us.

- The right to restrict (i.e., prevent) the processing of your personal data.
- The right to data portability (obtaining a copy of your personal data to re-use with another service or organisation)
- The right to object to us using your personal data for particular purposes
- Rights with respect to automated decision-making and profiling
- Your right to withdraw your consent at any time when we are relying on consent to process your personal data. However, this will not affect the lawfulness of any processing carried out before you withdraw your consent. If you withdraw your consent, we may not be able to provide certain products or services to you. We will advise you if this is the case at the time you withdraw your consent.

If we are unable to help you, you also have the right to lodge a complaint with the Office of the Data Protection Commission.

Any personal data which is collected through the use of our website will be processed and stored securely, for no longer than is necessary in light of the reason(s) for which it was first collected. We will comply with our obligations and safeguard your rights under the Data Protection Acts 1988 to 2002 and the GDPR.

6. How Do We Share Your Data?
We may contract with a third party to support us in what we do as described. In some cases, those third parties may require access to some or all of your personal data.
We will share your personal information with third parties only in the ways that are described in this Privacy Notice.
- Third parties authorised by you. We will disclose your personal information to a third party with your authorisation.
- Third-party service providers. We may provide your personal information to companies that provide services to help us with our business activities. These companies are authorised to use your personal information only as necessary to provide these services to us, based on our instructions and in compliance with this Privacy Notice and any other appropriate confidentiality and security measures. For example, we use Google Analytics for website monitoring.

We may also disclose your personal information as required by law, such as: to comply with a subpoena or similar legal process; when we believe in good faith that disclosure is necessary to protect our rights; to protect your safety or the safety of others; to investigate fraud; or, to respond to a government request. Where possible and legally permissible, we will consult you in advance of any such disclosure. We will reject any third-party requests for personal information that are not legally binding.
- Business transaction. If we are involved in a merger, acquisition, or sale of all or a portion of our assets, we may disclose your personal information to a third party involved in the transaction as permitted by applicable law.
- Affiliated businesses. Presidio may share your personal information with affiliates to provide the services including access to the Site and to improve or develop the Site.
- Third-party plugins. Your interactions with third-party plugins are governed by the privacy policy of the company providing the third-party plugin. Presidio is not responsible for the privacy and security practices of such third parties, and it is your choice to use such third-party plugins. We encourage you to read the privacy policy of any third party you interact with on or through the Site.
- Protection and safety of Presidio and others. We are committed to providing a safe environment on the Site. Presidio may disclose your personal information for purposes of fraud prevention and detection; protecting the rights, property, and safety of Presidio, you, or others; and enforcing or applying our Terms of Use and other agreements.
We will not share your data with any 3rd party partner for marketing purposes. Unless stated otherwise, transfers of personal data from within the European Economic Area (EEA) to third parties outside the EEA are based on an adequacy decision or are governed by the standard contractual clauses (SCC). Any other non-EEA-related transfers of your personal data will take place in accordance with the appropriate international data transfer mechanisms and standards.
7. How Long Do We Keep Your Data?
We will retain your personal data only for as long as necessary for the purposes outlined above related services provided to you, to comply with our legal obligations, resolve disputes, and enforce our agreements.
We maintain specific records management and retention policies and procedures so that personal data is deleted according to the following retention key criteria:
- As long as we have an ongoing and active relationship with you (particularly if you have a contract with us).
- As long as we have your consent keeping you
- As long as it is needed in order to comply with our global legal and contractual obligations.

8. How Do We Keep Your Data Secure and Confidential?
We are committed to ensuring that your information is secure with us and with any third parties who may act on our behalf. We have a number of security precautions in place to prevent the loss, misuse, or alteration of your information.
All staff working for Presidio have a legal duty to keep information about you confidential and all staff are aware of information security and confidentiality.
We hold an ISO27001 certification, which validates that we adhere to the highest and strictest information security standards. This is a security standard awarded and audited by an independent organisation - Certification Europe. ISO27001 is the only auditable international standard that defines the requirements for an Information Security Management System ("ISMS").
The security of your personal data is essential to us, and to protect your data, we take a number of important measures defined in our strict security policies, including the following:
- limiting access to your personal data to those employees, agents, contractors, and other third parties with a legitimate need to know and ensuring that they are subject to duties of confidentiality
- procedures for dealing with data breaches (the accidental or unlawful destruction, loss, alteration, unauthorised disclosure of, or access to, your personal data) including notifying you and/or the Data Protection Commission’s Office when we are legally required to do so
- regular penetration testing is performed by a third-party provider, which continues to ensure the strength of our technical defences
- training for staff in data protection policies and procedures
9. International Transfer
Your use of our website may from time to time involve the transfer, storage, and processing of your personal data to other countries outside of the European Economic Area. We will take appropriate measures, in compliance with applicable law, to ensure that your personal data remains protected. Such measures include the use of Standard Contractual Clauses to safeguard the transfer of data outside of the EEA.
As stipulated in Part 6 above, we may be requested by law, legal process, or court order from governmental authorities to disclose your information. Presidio also commits that if we are ever compelled by a valid and binding legal request to disclose member/customer data, we will disclose only the minimum amount of data necessary to satisfy the request.
